5. Subject, content and estimated value of contract
5.1 Object
The European Commission published the Action Plan for Forest Law Enforcement
Governance and Trade (FLEGT) in 2003, setting out a range of measures available to the
European Union and its Member states to tackle illegal logging in the world’s forests. For the
first time, the Plan explicitly recognised that the EU is a major consumer of wood products
from regions where levels of illegality and poor governance in the forest sector are more
serious, potentially providing valuable markets for illegal wood. European demand was seen
as a significant driver for illegality, and as a result, the European Commission was encouraged
to align its traditional forestry approach with a parallel focus on controlling markets for
potentially illegal wood with the EU. European Forest Institute’s EU FLEGT Facility supports
European Commission in implementing this Action plan.
The current call for tender constitutes the subcontracting work involving several fields of
services during implementation period of EU FLEGT Facility. Based on tenders received and
selected approved tenderers are rewarded with a Framework Agreement.
The Framework Agreement is an agreement between EFI and one or more economic
operators, its purpose is to establish the terms governing specific contracts which may be
awarded during a given period.
The framework agreement consists of eight (8) thematic areas under which EFI will be
procuring service contracts:
1 Forest governance
2 Capacity building
3 Markets and demand side measures
4 Legality Assurance Systems
5 Monitoring VPA impact
6 Communication and outreach – PR activities
7 Communication and outreach – Event arrangement
8 Communication and outreach – Film Producing
On the basis of shortlists drawn-up after review of the eligible tenders received, a maximum
of five (5) tenderers per thematic area will be invited to conclude a Framework Agreement.
5.2 Duration and estimated value
The duration of the framework agreement will be 24 months from the date of signing by the
Parties.
The estimated value of the contract is €200.000-800.000 per subheading, in total €3.000.000.

EFI shall publish a separate notification concerning the questions and answers concerning
the tendering procedure at http://www.efi.int/portal/projects/flegt/open_tenders/ on 14
June 2010 at 12.00 CET. Individual questions will not be replied to separately.
7. Rules governing EFI procurements
EFI applies EFI Procurement Rules which have been made available to the public at
http://www.efi.int/portal/about_efi/calls_for_tenders/.
The Rules do contain procedural requirements and conditions that differ from the EU
procurement legislation. All tenderers are encouraged to familiarize themselves with the
Rules. Tenderers are expected to follow the timelines and formal requirements set out in
the referred Rules, non-adherence of which may lead to the disqualification of the tenderer.

 


The Facility aims at having reforms adopted that improve governance and the functioning of markets, ensuring
that illegal logging and associated trade which adversely affect the poor are adequately tackled. The Facility’s
key work areas are (i) supporting the negotiation and implementation of Voluntary Partnership Agreements
(VPAs), bilateral trade agreements between the EU and timber product exporting countries, including analytical
studies guiding the VPA processes and a communication portfolio, and (ii) implementing the regional FLEGT
Asia support programme.

 


To reinforce the Facility’s team, EFI intends to engage a Deputy Manager and a Policy analyst, both reporting to
the Facility Manager, and a Governance expert, reporting to the Facility’s Senior Governance Expert.
Tasks and responsibilities

 


Deputy Manager
The Deputy Manager will be part of the FLEGT Facility management team consisting of the Facility Manager,
the Deputy Manager and the Administrative Manager. In particular her/his responsibilities will be:
Lead the Facility work planning, monitoring and reporting processes. Oversee work documentation and
maintenance of institutional memory.
Manage the Facility’s overall analytic studies portfolio, and supervise related assigned subcontracts.
Take responsibility of daily Facility management in collaboration with the Administrative Manager.
Contribute to tender processes and subcontractor selection.
Contribute to creating a common team vision on key FLEGT subjects.
Assist in preparing team events and cross-regional learning.
Contribute to reporting to the Steering Committee.
Maintain a good understanding of the Facility’s field work by being involved in technical tasks in certain
countries and in certain studies.
Provide input to the FLEGT ad-hoc working group.
Contribute to the Facility Newsletter and website.
Execute other tasks as assigned.

 


Governance Expert
The expert will provide guidance to the VPA processes on legality assurance system design and implementation, including governance related and institutional issues, such as participatory policy development.
The incumbent will work closely with FLEGT stakeholders in Europe and in partner countries including government, industry and NGOs. In particular s/he will:
Assess forest governance challenges in potential partner countries. Analyze current policies and identify reforms needed to achieve FLEGT-related goals. Assist, guide and facilitate individual VPA negotiations per request from the Commission. Together with the Legality Assurance System Experts assist countries in designing adequate Legality Assurance Systems (LAS) responding to requirements of the EC FLEGT briefing notes. Inform institutions and stakeholders on FLEGT and promote Voluntary Partnership Agreements or other arrangements that can be instrumental in achieving FLEGT goals. Track, analyze and disseminate relevant policy and trade developments in the EU and other consumer markets. Assess transparency and accountability measures in national forest sectors and assess any anticorruption measures. Assist in preparing policy briefs and other material relevant to communicating about the FLEGT programme. Compile lessons learnt on VPA processes. Provide input to the FLEGT ad-hoc working group. Contribute to donor progress reports. Contribute to the Facility Newsletter and website Execute other tasks as assigned.

 


Policy Analyst
The Policy Analyst will be responsible for the Facility’s analytical studies concerning the EU market and wider FLEGT questions (beyond VPA). In particular her/his responsibilities will be:
Manage EU market and wider FLEGT related analytical studies:
o Work closely with the Facility’s VPA team who will execute certain studies and policy analysis that require VPA negotiation knowledge.
o Execute certain studies her/himself.
o Manage studies subcontracted to qualified third parties.
o Develop good links with EFI network members and other specialized entities that can assist with certain studies. Assist in preparing policy briefs and other information material relevant to communicating FLEGT messages. Provide input to the FLEGT ad-hoc working group. Contribute to donor progress reports. Contribute to the Facility Newsletter and website. Execute other tasks as assigned.

 


Qualifications
Deputy Manager: At least 10 years of international project management experience. Proven experience in project cycle management and in use of logical framework approach. Familiarity with EFI is an added asset. At least 5 years of working experience in Africa and/or Latin America.

 


Excellent diplomatic and inter-personal skills, being impartial representing EFI in politically sensitive issues.
Governance Expert: Preferably 10 years of international working experience in forest policy analysis and formulation and policy reform processes. Ability of dealing with sensitive issues with governments, industry and civil society. Excellent diplomatic skills. Sound experience in participatory and consultative multi-stakeholder process facilitation. Being recognized as diplomatic, impartial and experienced facilitator and negotiator. Preferably 5 years working experience in Africa or Latin America.

 


Policy Analyst: Track record in preparing analytical studies. Proven experience in managing subcontracts.
All three positions MSc or higher university degree in forestry, natural resource management, policy science and economics or a related and suitable field. FLEGT experience is a considerable plus. Track record for creative and strategic thinking and pragmatic problem solving. Ability to work on complex and politically sensitive issues with governments, industry, NGOs and communities. Excellent communication and networking skills, solid writing, reporting and presentation skills. Demonstrated ability of working in multi-disciplinary, international teams and in multi-cultural environments. Good interpersonal skills. Proficiency in English and French or English and Spanish is required.

 


Duty station and travel

 


The Deputy Manager will be based at EFI HQ in Joensuu, Finland, the other two experts will be based either EFI HQ or at the EFI office in Brussels, with frequent travel within Europe and to FLEGT partner countries, mainly in Africa, Asia and Latin America.
