NATIONAL CONSULTANT: HCFC SURVEY AND INVESTMENT PROJECT IDENTIFICATION

Background

The Global Environmental Facility (GEF) has approved a Medium Size Project (MSP) that will be primarily directed to funding enabling activities in support of HCFC phase out in eligible Article 2 countries with economies in transition (CEITs) in Europe and Central Asia. Consistent with the GEF-4 Ozone Layer Depletion Focal Area Strategy and Strategic Program , the project is intended to assist these countries in maintaining or, where applicable, attaining compliance, with their Montreal Protocol obligations for HCFC phase out into the future, particularly noting the accelerated HCFC phase out requirements adopted by MOP 19 . The main focus of the project will involve undertaking detailed surveys in individual countries which will provide the information base to support country development of national phase out strategies to be used as input in to national HCFC Phase out Plans (HPMPs) and to identify needs for further international assistance in implementing these strategies at both a national level and through regional cooperation. This primary project component will be undertaken by UNDP for Belarus, Bulgaria, Kazakhstan, Tajikistan, Uzbekistan and Ukraine under the over coordination of UNDP/MPU-Chemicals and direct execution supervision of the UNDP Regional Bureau in Bratislava, Slovakia with local liaison support being provided by UNDP’s country offices in these countries. .

Other project components include a global macro-economic analysis about directions in HCFC use, production and trade worldwide being undertaken by the World Bank. This will include a focused analysis on the impact of these global factors on the CEIT countries, particularly the potential implications of the global HCFC demand and supply. Additionally UNEP is undertaking a third component addressing the inter-linkages HCFC phase out has with other Multi-Lateral Environmental Agreements (MEAs) and particularly recognizing the comparatively high global warming potential of HCFC’s and some of their alternatives as well as the potential for synergies in the management of HCFC phase out and the management of other chemicals such as POPs.

Ukraine, based on reported consumption information, shows growing consumption of HCFCs which may impact the status with respect to the accelerated phase out requirements for Article 2 countries under the Montreal Protocol in 2010, and is a key HCFC consumer in the region. Therefore, the HCFC survey will assist in determining a programme of action (investment and non-investment) to manage the consumption status.

This Terms of Reference applies to a national consultant to be contracted by UNDP in Ukraine. This particular national consultant will be known as the National Technical Consultant (NTC) and will primarily focus on direct information collection from enterprises involved in the import/export of HCFCs and other alternative chemicals using survey methods and direct contacts, as well as the identification of enterprise specific investment opportunities. The national consultant will be supported by an international consultant contracted by UNDP.

The project’s overall institutional counterpart in Ukraine is the State Ecological Inspectorate (SEI) within the Ministry of Environmental Protection of Ukraine (MEP). SEI has direct responsibility for the ODS licensing system and ODS regulatory enforcement, with the Head if SEI acting as the Chairman of the Interagency Coordinating Commission on Implementation of the Montreal Protocol. In this capacity, SEI are understood to currently have responsibility for the development of the HCFC Phase out Management Plan (HCFC) required by all Parties to the Montreal Protocol and which will use the results of this project. The work of the NTC covered by this TOR will involve cooperation with SEI, the other experts working directly with SEI, and coordination with field staff in relation to enterprise contacts as necessary.

 

Duties and Responsibilities

The NTC will report to the UNDP Project Manager based in the UNDP Regional Bureau in Bratislava, Slovakia and, as delegated, the UNDP International Consultant who has been contracted for this project with whom close liaison is required. Additionally, close cooperation is required with the other experts undertaking the collection and analysis of regulatory information through SEI, and with SEI in relation to development of the national HCFC phase out strategy. The Consultant will have specific responsibility to carry out the following main tasks in close coordination with UNDP, SEI, the International Consultant and other experts:

a) Coordinate the organization, setup and execution of his/her activities within the project boundaries;

b) Participate in regular project coordination meetings organized by SEI and UNDP, and coordinate her/his activities with the other experts, international consultant, and any other national or international consultants that may be working on the other aspects of the project;

c) Provide input and enterprise liaison as required to the other experts and SEI on results of the review and analysis of existing HCFC, other ODS and where available HFC official data undertaken by the other experts, specifically that which has been reported by Ukraine to the Ozone Secretariat of the Montreal Protocol, and SEI data on HCFC and HCFC containing equipment import/export, trade, and consumption as derived from the national ODS licensing system and from customs information;

d) Jointly with the international consultant finalize the HCFC survey guidance document and specific survey materials tailored to its requirements in Ukraine, and act as the local focal point for the administration of the survey and associated data collection and consolidation as elaborated below;

e) Identify any elements of previous international assistance involving both investment and non-investment aspects of ODS phase out that may be relevant to future HCFC phase out;

f) Conduct a desk study in association with the International Consultant with the aim being to prepare a situation analysis on HCFC consumption, import, export/re-export and distribution channels in-country. The data collection process will be guided by the HCFC survey guidance document noted above and be undertaken with the official support of SEI as required;

g) In the course of distributing and administering the survey, interact with various chemical and equipment suppliers/importers/distributors and/or their representatives, relevant industry associations all current users of HCFCs ; maintain continuous contact with these users and maintain an updated list of all such users. Where the situation necessitates it, embark on the in-country travel to elaborate and clarify data and other relevant background information.

h) With the prior approval of the UNDP Project Manager in consultations with UNDP International Consultant and SEI, undertake plant visits to selected major users and collect enterprise baseline information and other documentation as may be required from all users, in accordance with the HCFC survey guidance document provided for this purpose. The information to be gathered at enterprise level should contain but not limited to the following items if feasible:

  • General enterprise history, business scope, production capacity, product lines, basic financial performance information, and history of ODS (CFC and HCFC use);
  • Date(s) relevant production line(s) was/were established;
  • % local ownership and % foreign ownership (specify country and provide % for various countries if more than one);
  • % export of goods manufactured (by country if exports to more than one country);
  • CFC and HCFC use over the last three years and sources of supply;
  • Whether prior assistance already provided by GEF for CFC-phase out and description thereof; and
  • Actual production of products using ODS manufactured over at least the last 4 years by type / model.

i) Collect and consolidate the data generated according to the HCFC survey guidance document and its associated annexes;

j) Jointly with the international consultant, preparation of a final report on HCFC consumption, import, export/re-export and distribution channels in-country based on the HCFC survey results and inputs from the other experts, and including identification of prospective HCFC phase out investment opportunities suitable for more detailed development;

k) Assist in obtaining any other confirmations, documentation or information from the identified HCFC users as may be required by UNDP and/or NOU;

l) Facilitate and set up meetings for UNDP designated international experts and/or representatives, to meet with key managerial and technical personnel from stakeholder organizations, particularly major HCFC users and for plant visits as required, in line with their mission schedules in the country;

m) Facilitate the technology option discussions with involved industrial and commercial enterprises in various sectors and sub-sectors. These discussions should be held in close consultations with and under guidance from UNDP International Consultant, UNEP International Consultant, and UNDP with the involvement of SEI. Such task will involve coordination of activities with UNEP as it relates to climate change issues and inter-linkages between Multilateral Environmental Agreements;

n) Assist SEI and UNDP in arranging stakeholder workshops or similar information dissemination activities within Ukraine as may be requested, including assistance for ensuring participation of HCFC users selected for participating in such activities both in Ukraine and potentially regionally;

o) Assist SEI, UNDP and UNEP in identifying and setting priority actions (short, medium and long-term) and developing the draft national outline of HCFC phase-out strategy; and

p) Provide SEI, UNDP Project Manager, and UNDP International Consultant, with reports as defined under the milestones below.

 

Competencies

Assignment Reporting Milestones:

The following defines the main milestones where formal reports for which submission for the review of the NOU and International Consultant, and approval of the UNDP Project Manager are required, and which will govern payment under the contract for this assignment.

Milestone 1: Two (2) weeks after signature of the contract, prepare a work plan for the approval of the UNDP Project Manager in accordance with this TOR including a list and timing of tasks to be undertaken:

Milestone 2: Four (4) weeks after signature of the contract, final survey formats and implementation arrangements for its distribution in place, including a summary of intended survey target organizations, from initial contacts, and program of planned further contacts and follow up;

Milestone 3: Twelve (12) weeks after signature of the contract, a draft report with (1) the findings of the survey activities to date, (2) the expanded database on HCFC consumption and trade; (3) proposed program for approval of SEI and UNDP Project Manager of follow up activities to complete survey work including selected enterprise visits as applicable, and (4) preliminary conclusions and recommendations relevant to initiation of the HCFC Phase Out Strategy Outline;

Milestone 4: Twenty (20) weeks after signature of the contract, draft final report for approval of the SEI and UNDP Project Manager on the survey work including conclusions and recommendations relevant to initiation of the HCFC Phase Out Strategy Outline;

Milestone 5: Twenty five (25) weeks after signature of the contract, a draft report providing the consultant’s input into the HCFC Phase Out Strategy Outline and inputs as required into the identification of future HCFC investment opportunities including the base line information identified above from target enterprises.

Milestone 6: Thirty four (34) weeks after signature of the contract, a final report on the overall assignment incorporating the comments from the SEI, UNDP Project Manager and International Consultant, UNDP/MPU-Chemicals, UNEP and UNEP International consultants.

All reports shall be in the Russian language and be provided in MS Office electronic format.

Payment Schedule:

The following summarizes the payment schedule (early delivery of a milestone is considered as achieving a milestone) against the above milestones made upon approval of the UNDP Project Manager as a percentage of the contract value:
  • Initial Payment: 10% upon completion of Milestone 1
  • First Interim Payment: 25% upon Completion of Milestone 2
  • Second Interim Payment: 25% upon Completion of Milestone 3
  • Third Interim Payment: 15% upon Completion of Milestone 4
  • Fourth Interim Payment: 15% upon Completion of Milestone 5
  • Final Payment: 10% upon completion of Milestone 6
Responsibility for Expenses and their Reimbursement:

The Consultant will be responsible for all administrative and travel expenses associated with undertaking this assignment including office accommodation, printing, stationary, telephone and electronic communications, and report copies incurred in this assignment. Limited in-country travel is anticipated in association with this assignment and is covered by an allowance of US$3,000 which is included in the lump sum contracted amount for this assignment and is intended to cover vehicle/train/airfare cost, accommodation and DSA . Additional travel as may be requested by the UNDP Project Manager will be subject to approval and agreement on reimbursable expenditures in advance to cover travel costs.

 

Required Skills and Experience

  • As a minimum, master’s (or diploma) degree in natural resource management, environment, engineering, statistics, social science or equivalent with a minimum ten (10) years experience in the CFC/HCFC-related industry with close relevant industry contacts in Ukraine;
  • Knowledge/understanding of the Montreal Protocol issues;
  • Previous experience in carrying out similar surveys is preferable;
  • Direct practical experience with implementation of ODS phase out activities in a major relevant sector, preferably involving international assistance;
  • Good knowledge of Russian; Ability to speak and write in English is welcome, but not necessarily required;
  • Knowledge of MS Word, Excel and email communication software;
