Background

The United Nations Development Programme (UNDP) Lebanon is implementing a project entitled “Supporting the Judiciary System in the Enforcement of Environmental Legislation”. The project is co-funded by the World Bank and UNDP, and is executed at the Ministry of Justice.

This project aims at building the capacity of the Lebanese Ministry of Justice in environmental legislation and enforcement; a priority sector for both UNDP and the World Bank.  Lebanon has recently experienced an important progress in environmental policy and legislation development and application. Several key environmental legislations have been adopted by the parliament since the year 2000 which is a good indicator of the environmental maturity of the country and its efforts towards sustainable development; however, the enforcement of such legislation is what determines whether it has an effective impact on the environment or not.  In Lebanon, the level of enforcement is very limited and almost nonexistent. This is due to the very weak capacity and institutional setup of the Ministry of Justice and the overall Lebanese Judiciary system.

The day to day project operations is carried out by the Project Management Unit (PMU) based at the Ministry of Justice, therefore ensuring access to the Ministry’s facilities.  The PMU consists of a Project Manager, Legal Officer/Project Assistant and Project National Coordinator.

The objective and scope of this work is to develop and introduce an environmental law course at the Institute of Judicial Training at the Lebanese Ministry of Justice.

The course should be developed in close coordination with the PMU and key project partners including the Ministry of Justice and the Ministry of Environment. The project main stakeholders are:

  • Ministry of Justice;
  • Institute of Judicial Training;
  • Ministry of Environment;
  • Programme donors;
  • Constitutional council;
  • Related bars association;
  • NGO’s
  • Various projects staff;
  • Other UNDP Programmes

 

Duties and Responsibilities

Tasks

  1. Provide the PMU with environmental law courses offered at international universities and international Judicial Institutes with similar legal systems as Lebanon and undertake a comparative analysis between them. Selection of the international institutes should be undertaken in consultation with the PMU and the national environmental legislation expert (5 working days)
  2. Based on task a, provide guidance to the national environmental legislation expert and the PMU on the most appropriate methodology for developing the national environmental law course to be introduced at the Lebanese training Judicial Institute. (5 working days)
  3. Review the environmental course developed by the national environmental legislation expert and the PMU and propose any needed enhancement and improvement (10 working days)
  4. Assist the PMU in conducting a comparative analysis between Lebanese, International (Non-European), and European environmental jurisprudence. (5 working days)
  5. Review and advice on the workshop training material prepared by the national consultant and conduct at least 2 training workshops to disseminate the findings. (5 working days).

Outputs and due dates:

10/01/2009: Report concerning the analysis of the environmental law courses offered at international universities and international Judicial institutes.

31/01/2009: Course methodology and syllabus and first chapters of the course finalized.

01/03/2009: Revise the environmental course developed by national expert/PMU including detailed comments /suggestions. And deliver as a final output the environmental course finalized.

30/09/2009: Present at least two workshops including material (presentation, hand-outs,...) and workshop reports.

Purchases & Inputs

UNDP Lebanon Country Office and the PMU will provide the Consultant with all the required documents and will assist the Consultant in setting up meetings with concerned stakeholders.

Travel: up to 2 missions to Lebanon are required. International travel to Lebanon and travel within Lebanon should be arranged by the Consultant. UNDP Country Office will cover expenses related to air travel, terminal expenses and daily subsistence as per UNDP rates allowance during mission days. The Consultant must take all required security courses and clearance before travel to Lebanon.

 

Competencies

Preferable that the expert has work experience in introducing similar courses in Judicial Institutes.
Willingness to travel to Lebanon is a requirement.

 

Required Skills and Experience

Education:

  • PhD in environmental law or any related field.

Experience:

  • At least 8 years of experience in teaching environmental law course or any related discipline at a reputable international university.
  • International experience in environmental law or any related field.
  • Demonstrated experience in research skills.
  • Communication skills.
  • Demonstrated experience in working with public sector and/or international/UN agencies.

Language Requirements:

  • The consultant should have excellent verbal and written knowledge of English and French.
