Background

Like many countries around the world, Lesotho has endorsed the concept of sustainable living and sustainable use of its natural resources. EIA is an important tool used to support sustainable living because it requires looking carefully at actions before unacceptable change occurs. The Environment Act, 2008, implemented by Department of Environment, provides for undertaking an EIA. The term “Environment’’ in the Act is used in the broadest sense and includes bio-physical, economic and socio-cultural aspects. EIA is designed to ensure that the environmental consequences of developmental activity are understood and adequately considered in the planning process. The Department of Environment is currently using draft EIA Regulations of 2006 which are not in line with the Environment Act, 2008. It is with this background that the Department wishes to amend and align such regulations with the existing Environment Act, 2008.

Duties and Responsibilities

This is a short-term consultancy assignment that takes 20 days. Remuneration shall be paid upon submission of a final report stipulating tasks and achievements. The report will be submitted to the Dept of Environment then certified by UNDP Country Office. These advisors will be located at the Dept or UNDP and work on daily basis with the relevant departments. The Dept of Environment will manage this assignment and ensure both Dept and UNDP are informed of progress and address any issues arising.

 

Duties and Responsibilities

The activities to be undertaken by Experts are:

  1. Review of existing relevant national legislation, guidelines and policies and institutions relating to EIA process in Lesotho;
  2. Comparative review of existing draft regulations with that of other jurisdictions;
  3. Review relevant international instruments having direct relevance to EIA process;
  4. Consultation with key stakeholders in DoE, relevant Ministries, industry and the general public;
  5. Prepare a comprehensive report on the findings of reviews and consultations;
  6. Review and align the existing regulations with the existing Act - Environment Act (2008)
  7. Because of the link between capital projects and HIV/AIDS depends on a number of factors, but key among them is population migration, both within and between countries, and the changing of sexual networks that ensues hence a critical step to breaking the link between capital projects and the spread of HIV/AIDs is strengthening Environmental Impact Assessment (EIA) legislation pertaining to these key populations and particularly on issues of HIV and gender. Consultants should therefore mainstream HIV/AIDS and Gender in this regulation according to international best practices.
The regulation should comply with basic international EIA regulations covering issues such as;

  • Screening
  • Withdrawal of registration of an undertaking
  • Scope of EIA
  • Environmental Permit Decision
  • EIA Procedural steps
  • Public Participation
  • Review Panel
  • Compliance monitoring system
  • Arbitration

Required Skills and Experience

Education:
  • A PH.D or Masters in a related subject and preferably in Environmental Impact Assessment.
Experience:
  • Proven knowledge of EIA/ESIA/ESHIA and current Best Practice Guidance.
  • Considerable knowledge of environmental assessment techniques.
  • Excellent project management and financial management skills required.
  • Flexibility to be able to work on a wide range of EIA projects.
  • Ideally experience of undertaking EIA/ESIA/ESHIAs in a variety of sectors, in particular offshore, oil and gas and infrastructure.
  • Experience of managing projects in a consultancy environment.
Applications will be evaluated based on a cumulative analysis taking into consideration the combination of the applicants’ qualifications and financial proposal as follows:
  • Technical Criteria – 70% of total evaluation – max. 70 points:
  • Academic and professional background – 10 points max
  • Experience in international development – 10 points max
  • Technical expertise and demonstrated technical competencies – 30 points max
  • Experience in similar assignments – 20 points max
  • Financial Criteria – 30% of total evaluation – maximum 30 points.
Only the highest-ranked candidates who are found qualified for the job will be considered for the Financial Evaluation.
