Background

Technical, commercial, implementation and legal framework review of Malaysia’s National Implementation Plan for the Stockholm Convention on Persistent Organic Pollutants (POPs).
 
The consultant will review the existing National Implementation Plan for compliance to the Stockholm Convention provided and scrutinise the document on the technical, commercial, implementation and legal framework viability for Malaysia. The consultant will oversee and manage the formulation of the Persistent Organic Pollutants National Implementation Plan if necessary. The consultant will also propose training options for the various stakeholders and the public. All recommendations must be made in pursuit of ratifying the Stockholm Convention.
 
Period of assignment/services (if applicable): April – December 2012 .

Malaysia signed the Stockholm Convention on 16 May 2002 and to date has not ratified the Convention yet. Although Malaysia is not yet a party, it has taken a proactive step to develop a National Implementation Plan (NIP) in preparation for its eventual ratification and obligation as a party to the Stockholm Convention. The NIP contains information on Malaysia’s existing measures in the management of persistent organic pollutants (POPs) and its future strategy, action plans and activities to reduce and eliminate the production or release of POPs in the country. Therefore the NIP will be the reference document for all stakeholders for information and coordination of activities during implementation stage. The NIP has also identified the role of each agency involved in the implementation of the Convention. We foresee that the NIP will be a practical document to enable the government of Malaysia to strengthen national capacity to manage POPs and to assist Malaysia in meeting the obligations under the Stockholm Convention.
 
The Malaysia Government, through the Ministry of Natural Resource and Environment (NRE) is currently developing enabling activities in fulfilment of its obligations to the Stockholm Convention on Persistent Organic Pollutants (POPs).

 

Duties and Responsibilities

Deliverables:
 
The Consultant will:
 
  • Assist NRE in the establishment of a project coordination unit; and in consultation and collaboration with the NRE project focal point, execute a series of stakeholder meetings and workshops to facilitate meetings with key stakeholders in government, the private sector, non-governmental organizations, and other agencies or individuals involved in chemicals usage and management in The Malaysia. This consultation will aid in establishing the mechanism to achieve inventory processes, priority setting, gain input for NIP implementation in The Malaysia, and generally ensure broad stakeholder and national consensus on the products of this exercise.
  • Produce a report for each of the chemicals listed in Annex A, B and C with a description not limited to the following characteristics of the chemicals:
  • CAS number; Physical properties; Chemical properties and functions; Applications; Exposure limits; Industries affected by its restricted use;
  • Assess existing hazardous chemicals management capacity, infrastructure, laws, and environmental, commercial impacts from restricted use and human health impacts;
  • Identify priority actions for improvements in said areas as inputs for the possibility of ratifying the Stockholm Convention;
  • Identify step necessary through stakeholder consultation for the government of Malaysia to ratify the Stockholm Convention;
  • Identify a broad framework for POPs in Malaysia for subsequent implementation.
Methodology of Work:
 
During the contract period, the consultant shall work according to the following methodology:
  • Consult stakeholders to assist in the identification of hazardous chemicals/POPs;
  • Consultant shall submit an initial plan of action for approval by NRE;
  • The consultant shall seek approval of NRE for all revisions to the plan;
  • Review the National Implementation Plan provided and scrutinise the document on the technical, commercial, implementation and legal framework viability for Malaysia in conjunction with NRE;
  • Formulate workshops to consult stakeholders to assist in the identification of hazardous chemicals/POPs, validation and endorsement of POPs inventory, training participants on NIS and POPs Inventory and Management Procedures, NIP development, and proposed action plan on POPs, and National endorsement of NIP by stakeholders;
  • Accompany government representative to technical meetings when requested.
Timetable:
The consultant shall be retained to the 31st of December 2012 from the execution of its contract with UNDP. All work-plan activities and project deliverables must be completed within the duration of the contract, and all deliverables received by the contract deadlines. Within five (5) working days of the signing of the Contract, the initial plan of action for completion of all deliverables shall be submitted to NRE for approval. The deadlines for submission of all project deliverables will be according to the work plan.
 
Equipment requirements:
The consultant must have a laptop, appropriate back-up and storage of electronic data, for use in fulfilling the deliverables of the contract and submitting all electronic files in PC compatible MS Office 2007 format to NRE.
 
Terms of payment:
The consultant is to quote a lump sum figure for the completion of the above deliverables. A milestone payment schedule will only be determined upon the completion and agreement of the initial action plan with NRE.

Competencies

Experience:
  • Experienced in the field of persistent organic pollutants. Experience in the Pacific in the field of persistent organic pollutants is an added advantage. The consultant or organization should have general knowledge of the national chemicals situation or should have access to such information when available;
  • Well versed with the Stockholm Convention on POPs;
  • Good understanding of UNDP/GEF requirements is an added advantage;
  • Familiarity with legislation on waste management, chemicals management and waste pesticides;
  • The candidate should be highly motivated and capable of working independently. Ability to work with a wide variety of people from governments, agencies, private companies, NGOs, and research institutions is essential.

 

Required Skills and Experience

Qualifications:

Interested individuals or organizations shall present the following qualifications:

  • MSc. Level University degree or higher in law, environmental sciences, chemistry, engineering or related field with demonstrated understanding of the Stockholm Convention on POPs, its goals and objectives;
  • 3 years experience developing inventories, creating action plans, and strategic planning documents for governments;
  • Excellent English language communication skills (read, write, and speak).
