Description
The Global Environmental Facility (GEF) has approved a Medium Size Project (MSP) that will be primarily directed to funding enabling activities in support of HCFC phase out in eligible Article 2 countries with economies in transition (CEITs) in Europe and Central Asia. Consistent with the GEF-4 Ozone Layer Depletion Focal Area Strategy and Strategic Program , the project is intended to assist these countries in maintaining or, where applicable, attaining compliance, with their Montreal Protocol obligations for HCFC phase out into the future, particularly noting the accelerated HCFC phase out requirements adopted by MOP 19 . The main focus of the project will involve undertaking detailed surveys in individual countries which will provide the information base to support country development of national phase out strategies to be used as input in to national HCFC Phase out Plans (HPMPs), and to identify needs for further international assistance in implementing these strategies at both a national level and through regional cooperation. This primary project component will be undertaken by UNDP for Belarus, Bulgaria, Kazakhstan, Tajikistan, Uzbekistan and Ukraine  under the over coordination of UNDP/MPU-Chemicals and direct execution supervision of the UNDP Regional Bureau in Bratislava, Slovakia with local liaison support being provided by UNDP’s country offices in these countries. .

Other project components include a global macro-economic analysis about directions in HCFC use, production and trade worldwide being undertaken by the World Bank. This will include a focused analysis on the impact of these global factors on the CEIT countries, particularly the potential implications of the global HCFC demand and supply. Additionally UNEP is undertaking a third component addressing the inter-linkages HCFC phase out has with other Multi-Lateral Environmental Agreements (MEAs) and particularly recognizing the comparatively high global warming potential of HCFC’s and some of their alternatives as well as the potential for synergies in the management of HCFC phase out and the management of other chemicals such as POPs.

Ukraine, based on reported consumption information, shows growing consumption of HCFCs which may impact the status with respect to the accelerated phase out requirements for Article 2 countries under the Montreal Protocol in 2010, and is a key HCFC consumer in the region. Therefore, the HCFC survey will assist in determining a programme of action (investment and non-investment) to manage the consumption status.

This Terms of Reference applies to one of two national consultants to be contracted by UNDP in Ukraine.  This particular national consultant will be known as the National Regulatory Consultant (NRC) and will primarily focus on the collection and analysis of information and data related to HCFC import, export and use that comes from Ukraine’s regulation of ODS, specifically through the national  licensing and customs control systems. The national consultant will provide input into the development of an outline of a national phase out strategy. He/she will be supported by an international consultant contracted by UNDP.

The project’s overall institutional counterpart in Ukraine is the Ministry of Environmental Protection of Ukraine (MEP).  MEP has direct responsibility for the ODS licensing system and ODS regulatory enforcement.  The work of the NRC covered by this TOR will primarily involve cooperation with MEP and through them other agencies such as the State Customs Committee.

 

Duties and Responsibilities

Responsibilities:
   
The NRC will report to the Head of Air Protection Department of MEP, and the UNDP Project Manager based in the UNDP Regional Bureau in Bratislava, Slovakia. The Consultant will liaise closely with the UNDP International Consultant who has been contracted for this project and with other experts undertaking technical survey and information collection at the enterprise level. The Consultant will have specific responsibility to carry out the following main tasks in close coordination with UNDP, MEP, the International Consultant and other experts:

  1. Coordinate the organization, setup and execution of his/her activities within the project boundaries;
  2. Coordinate her/his activities with other experts, international consultant, and any other national or international consultants that may be working on the other aspects of the project;
  3. Undertake a detailed review of official data related to HCFC, other ODS and where available HFC data. This will include data that has been reported by Ukraine to the Ozone Secretariat of the Montreal Protocol since 1997, and data on import/export, trade, and consumption of HCFC and as applicable HCFC containing equipment, as derived from the national ODS licensing system, from Customs information. In the case of data reported to the Ozone Secretariat this shall included an explanation of how these numbers were derived and their relationship to the licensing system and import/export data.
  4. Review and update documentation available from an earlier National Regulatory Consultant’s work respecting information and documentation on the current national legal and regulatory framework governing ODS including a description of applicable legislation, regulations (licensing, import/export control, any quota system for allocation of material, etc.), as well as a description of the institutional structure involved and an assessment of the current administrative practices and resources available for its implementation.  Associated with this should be an analysis of any identified gaps or deficiencies in the existing regulatory framework requiring changes to maintain consistency with current Montreal Protocol obligations.
  5. Provide input and peer review assistance to the initial desk study undertaken by the other experts and International Consultant with the aim being to prepare a situation analysis on HCFC consumption, import, export/re-export and distribution channels in Ukraine;
  6. Assist in obtaining any other confirmations, documentation or information from the identified HCFC users as may be required by UNDP and/or MEP.
  7. Facilitate and set up meetings, as requested, for UNDP designated international experts and/or representatives, to meet with key managerial and technical personnel from stakeholder organizations within the government, in line with their mission schedules in the country;
  8. Assist MEP and UNDP in identifying and setting priority actions (short, medium and long-term) and developing the draft national outline of HCFC phase-out strategy;  and
  9. Provide MEP, UNDP Project Manager, and UNDP International Consultant, with reports as defined under the milestones below.

Assignment Reporting Milestones:

The following defines the main milestones where formal reports for which submission for the review of the MEP and International Consultant, and approval of the UNDP Project Manager are required, and which will govern payment under the contract for this assignment.

Milestone 1: Two (2) weeks after signature of the contract, a draft report elaborating the current institutional structure and regulatory framework controlling ODS and specifically HCFCs in Ukraine, an analysis of this respecting gaps and deficiencies that need to addressed for compliance with current Montreal Protocol obligations;
Milestone 2: Fourteen (14) weeks after signature of the contract: a progress report on the results of review and analysis of official annual reporting data made since 1997 up until 2009 to the Ozone Secretariat, and data derived from the national ODS licensing system and customs information.  The latter should include identification and contact information of all principle importers, exporters, distributors and consumers of HCFC suitable for use by the other experts;

All reports shall be in the Russian language and be provided in MS Office electronic format.

Payment Schedule:

The following summarizes the payment schedule (early delivery of a milestone is considered as achieving a milestone) against the above milestones made upon approval of the UNDP Project Manager as a percentage of the contract value:

  • First Payment:         30% upon completion of Milestone 1
  • Last Payment:             70% upon Completion of Milestone 2

Responsibility for Expenses and their Reimbursement:

The Consultant will be responsible for all administrative and travel expenses associated with undertaking this assignment including office accommodation, printing, stationary, telephone and electronic communications, and report copies incurred in this assignment. No domestic travel is expected throughout the whole duration of the assignment.

 

Competencies

  • Knowledge/understanding of the Montreal Protocol issues;
  • Knowledge of MS Word, Excel and email communication software;

 

Required Skills and Experience

  • As a minimum, master’s (or diploma) degree in natural resource management, environment, engineering, statistics, social science or equivalent with a minimum 3 years experience in the CFC/HCFC management;
  • Direct experience with regulatory control and enforcement activities related to ODS in Ukraine;
  • Previous experience in the management and reporting of regulatory information related to ODS in Ukraine;
  • Good knowledge of Russian; Ability to speak and write in English is welcome, but not necessarily required;
